Tenant Fraud Epidemic Grips UK Rental Market

Almost eight in ten UK landlords believe tenant fraud has become more prevalent over the past three years, according to fresh research from LegalforLandlords. A survey of 1,000 landlords found that 77% perceive an increase in fraudulent tenancy activity, with 39% describing the rise as "significantly more common" and a further 38% reporting it as "somewhat more common."

The findings underscore growing concerns across the rental sector, particularly following the BBC Panorama investigation There's a Gangster in My Flat, which exposed serious cases of tenancy fraud and its devastating consequences.

Direct Impact: One in Ten Landlords Affected

One in ten landlords surveyed reported experiencing tenant fraud first-hand, with the most prevalent form involving tenants deliberately withholding rent payments after supplying misleading information during the application stage. This scenario accounted for 34% of reported fraud cases.

Other significant fraud types included:

  • Property misuse for criminal activity: 19% of affected landlords discovered their properties had been used unknowingly for criminal purposes
  • Unauthorised subletting or rent-to-rent schemes: 10% of cases
  • False employment or income information: 9% of serious incidents
  • Undisclosed occupants: 9% of major cases

These varied tactics demonstrate how sophisticated tenant fraud has become, requiring landlords to implement robust screening processes from the outset.

Financial Toll Remains Substantial

The financial consequences of tenant fraud can be severe. Almost a quarter (24%) of affected landlords reported losses exceeding £5,000 from their most serious incident, whilst a further 22% experienced losses between £2,500 and £4,999. Only 2% escaped without financial loss.

The recovery picture is equally concerning: nearly a third (31%) of landlords absorbed losses entirely without recovering any money. A further 22% pursued formal eviction proceedings to resolve matters, whilst more than one in ten (12%) cases remained unresolved at the time of the survey.

Whilst most affected landlords experienced fraud only once within five years, almost a third reported multiple incidents, suggesting repeat offenders pose an ongoing threat.

Strengthening Defences Against Fraud

Sim Sekhon, group chief executive of LegalforLandlords, commented: "The recent Panorama programme has shone a light on some of the most serious examples of tenancy fraud, but our research suggests the wider concern among landlords extends far beyond the cases that make the headlines. Most tenants are genuine, but the financial impact when fraud does occur can be significant."

Sekhon emphasised that sophisticated fraudsters now employ multiple tactics, from misleading affordability information and undisclosed occupants to fabricated identities and organised criminal activity. The challenge for landlords is that problems often remain hidden until after a tenancy has commenced, when remediation becomes considerably more expensive and time-consuming.

Experts recommend that landlords prioritise thorough tenant referencing, identity verification, and affordability checks—supported by appropriate legal protection—as essential defences against evolving fraud tactics. Implementing robust screening procedures and leveraging planning alert tools to understand local property demand patterns can help landlords make more informed tenancy decisions.
